Considering Inmate Miller committed his crimes at the advanced age of 49 yes he is a threat. There are no facts indicating he is at "deaths door". I am not familiar with Prosecutor Gains other cases. In this case he did the right thing.
The first step to rehabilitation is taking responsibility for your actions. Per the Ohio Department of Corrections: "Miller was last heard by the Parole Board in August 2010. He denied shooting the victims and claimed that he was set up by police. Miller took no responsibility for any of his actions." In addition, this inmate attempted to kill a police officer and is still blaming police for his incarceration. He is a danger to society and a threat to law enforcement. He needs to remain in prison. Gains made the right call. Would you want this man next to your family member in a nursing home?
