Sitting in the courtroom, with a briefcase full of evidence.... evidence both the judge and probation officer knew would be present, as well as witnesses... yet, we were as voiceless as the victims of Steve Croley and others like him. We specifically asked the judge to be heard (in writing), a request that was simply ignored.
The important thing is there was nobody to ask questions other than the defense. Had there been someone to do that, the question would have been asked, how did the wife acquire dogs that formerly belong to her husband and HIS EXWIFE? When did Hannah and Peanut come into the home? Reality is Croley and the dogs moved in in March, a month after he met his new wife although they did not get married until 7 months later. They did not tell the whole truth. 2 of those dogs were removed from Croley in the 2008 case. He boasts one is worth 25k, no way he is not going to have his dogs, dogs he owned for years before he met his new wife.
Also, if the court order says no dogs, how can the probation office in the first place be fine with him owning dogs without getting leave of the court?
This proceeding was an embarrassment to the judicial system as a whole. It was an ex-parte preceeding, with the party that had the burden of proving the allegations absent from the proceedings entirely in the beginning, then when appeared, did so merely as a WITNESS for the DEFENSE
Our organization sent written communication to both the Judge and the Probation Officer regarding witnesses and evidence in our possession. It was detailed. We hope they contemplated the contents and do the right thing.
and... where are the violation of probations for moving without telling his probation officer, transporting dogs with a local rescue person (harboring surely in a vehicle) and the violation for his 2010 OVI criminal case where he also got 12 months probation in another municipality? He was only violated for owning/harboring, and has earned more violation of probation charges in addition. Bring those charges on...
Probation officers in the surrounding counties are generally law enforcement officers, that also serve as court bailiff's and are trained and do carry guns. Perhaps if Youngstown doesn't have qualified people to serve as probation officers, they should seriously re-evaluate their hiring standands to limit those applying to be a probation officer have those qualifications, and in the meanwhile, simply pick up the phone and call the law enforcement agency to assist, but NO MORE EXCUSES for NOT supervising defendants that are on "supervised" probation.
Remove the animals, charge the new wife with abetting. He owned 2 of those dogs before he married her and they were removed from him in 2008. There is no "magic" number of years he should be prohitted from owning animals, it should be he be prohibited from "ever" owning animals, harboring them or even being near them. His earnings are directly related to animals, he needs a job in a convenience store as a check out clerk or goods stocker, not be allowed to train, transport, harbor, own animals, for life.
