CRAIG TRIAL | Sides battle over witness statement

YOUNGSTOWN — Attorneys in Mahoning County Common Pleas Court today are haggling over a statement a key witness in a trial of a man accused of an October shooting at the Walmart in Austintown on Mahoning Avenue.

Judge John Durkin is hearing testimony out of earshot in the testimony of Terrance Craig, 26, of Campbell, who faces a charge of felonious assault.

The statement comes from an eyewitness to the shooting who spoke to a township detective shortly after a man was wounded in the parking lot of the Walmart.

The woman is unavailable for testimony because she can not be found. Prosecutors are trying to admit her statement as an exception to the hearsay rule under the excited utterance exception.

Judge Durkin will watch a video of the statement before issuing a ruling.

Testimony in the case began Monday after a jury was selected.
