Victim’s mom asks for lesser sentence in rape

WARREN

David J. Schmitt, 19, of Watson-Marshal Road in McDonald, was sentenced to four years in prison Wednesday in Trumbull County Common Pleas Court after pleading guilty earlier to three counts of rape involving a girl, 11.

Schmitt was indicted on three counts of rape that each carried a possible prison sentence of life in prison, but at the request of the victim’s mother, the charges were amended to ones that did not carry the potential for a life prison sentence, said Gabe Wildman, assistant county prosecutor.

The girl was a willing participant in the sex, but a child of 11 is not old enough under Ohio law to consent to sex, Wildman said.

Police said the rapes occurred April 24, and police were notified by the school district April 29.

When he leaves prison, Schmitt will have to register as a sex offender for life.
