BREAKING NEWS: Ben Lupo sentenced to 28 months in prison, fined $25K

CLEVELAND — Ben Lupo was sentenced today to 28 months in federal prison for ordering illegal discharges of oilfield waste down a storm drain and into a Mahoning River tributary in Youngstown.

U.S. District Court Judge Donald C. Nugent imposed the sentence today on Lupo, 64, of Springfield Township, who had earlier pleaded guilty to violating the federal Clean Water Act. The hearing lasted about three hours.

The judge also fined him $25,000. He will be allowed to self-report to prison.

The discharges from Lupo’s Salt Springs Road waste storage tanks, which ended Jan. 31, 2013, resulted in a $3.1 million cleanup.

The U.S. Attorney sought the maximum sentence - three years in prison and a $250,000 fine - to deter others from similar conduct.
