Postponement sought in rape and death preliminary hearing
The defense attorney for a man charged in the rape and death of a 14-year-old boy is hoping to postpone a preliminary hearing scheduled for today.
On Friday, attorney Ron Yarwood filed a motion to continue the preliminary hearing for Zaryl G. Bush, 43, of 533 Creed St, The hearing is scheduled for 9:30 a.m.
If the motion is granted by Judge James R. Lanzo of Struthers Municipal Court, however, the preliminary hearing would be moved to April 9, according to a court docket.
Bush is charged in the murder of Theodore “Teddy” A. Foltz, who died from head trauma on Jan. 21 at St. Elizabeth Health Center in Youngstown.
Teddy’s Mother, Shain P. Widdersheim, 32, of 28 Creed St., is Foltz’s ex-girlfriend. She is facing one count of child endangerment, a second-degree felony. She is scheduled to appear in municipal court today as well.
Police said they don’t believe Teddy’s injuries were caused by Widdersheim.
Teddy lived with his mother, but it is not clear whether he was injured at his mother’s residence or Bush’s residence, police said. Officers said Widdersheim kept the boy at home “for several” hours after his injuries before he was taken to the hospital.
Family friends have alleged that Widdersheim knew Bush was abusing Teddy, along with her other two children, before Teddy died last month. Both of Widdersheim’s children are now in protective custody.
Police said their investigation began Jan. 23, two days after Widdersheim brought Teddy to Akron Children’s Hospital Mahoning Valley in Boardman.
His injuries on Jan. 21 were so severe he immediately was transferred to St. Elizabeth.
Widdersheim is in Mahoning County jail in lieu of paying 10 percent of a $100,000 bond. Bush is also in jail with a $1 million bond.
