A man who stole about $1.3 million from a trucking company he co-founded has been denied judicial release from prison.

In a judgment entry filed Wednesday, Judge Lou A. D’Apolito overruled a motion for release filed by Scott Adair, 53, who pleaded guilty to embezzling from Southwind Transportation Inc.

Judge D’Apolito, of Mahoning County Common Pleas Court, had sentenced Adair in August 2011 to four years in prison.

Adair sought his release from the Marion Correction Institution, saying he has been a “model prisoner” with no prior criminal record and that members of his family would benefit from his release.

Saying Adair “plundered a company to satisfy his personal greed,” causing its bankruptcy and unemployment for its workers, an assistant county prosecutor opposed Adair’s release.
