WASHINGTON (AP) — The Supreme Court will take up California's ban on same-sex marriage, a case that could give the justices the chance to rule on whether gay Americans have the same constitutional right to marry as heterosexuals.
The justices said Monday they will review a federal appeals court ruling that struck down the state's gay-marriage ban, though on narrow grounds. The San Francisco-based appeals court said the state could not take away the same-sex marriage right that had been granted by California's Supreme Court.
The court also will decide whether Congress can deprive legally married gay couples of federal benefits otherwise available to married people. A provision of the federal Defense of Marriage Act limits a range of health and pension benefits, as well as favorable tax treatment, to heterosexual couples.

What happened to the idea that "All men are created equal?" The Supreme Court must rule in favor of gay marriage.
I just want the Supreme court to side with the militant gay left as soon as possible. I'm tired of the whole issue being shoved down our throats. everytime you turn on the tv the left is polluting our children's minds and making the gay thing look cool. I am sorry that you are a homosexual. But that doesn't mean that you have the right to have society recognize a relationship you may have as a marriage - when it is with someone of the same sex.
What's to stop a niece and an aunt, a mother and a daughter, or three people from declaring their relationships as marriages?
If marriage is a purely humanly defined institution, what's to stop someone from marrying his dog - if it were "made legal"? I notice militant homosexuals never mention bestiality. What about people who have sex with animals - don't they have the right to marry their "lovers" too?
