YOUNGSTOWN — A West Midlothian Boulevard woman has sued Mahoning County, saying her 9-year-old son was painfully bitten and permanently injured by a dog negligently let loose while he worked as a volunteer animal caregiver at the county dog pound.
Mary Ann Byrns filed the suit this week in Mahoning County Common Pleas Court on behalf of her son, Phillip J. Byrns, saying he was bitten on his leg and elsewhere Sept. 15, 2010, by a dog with “a known propensity to bite.”
The suit, which demands a jury trial and more than $25,000 in damages, is assigned to Judge R. Scott Krichbaum.
County Prosecutor Paul J. Gains, who defends county officials, declined to comment on the lawsuit.

2 questions.
1) What was a 9 year old doing working at the dog pound? You have no idea what type of dogs and what they are going to do.
2) WHERE WAS MOM???
A 9-year-old is too young to volunteer around dogs...see what allegedly happened? Sounds like a quick-cash scheme.
2 years later she wants to sue the County? Just looking for the $$$$$.
Thanks lady.....Mahoning County may have to stop allowing "volunteers" into the facility to help with the dogs for "liability reasons."
I'm sure there are waivers to avoid such frivolous claims....anyone who is around dogs knows that dogs are animals and animals can be unpredictable. When this mother allowed her child to enter the pound and "volunteer" his time, she assumed the risk that a dog may bite her son.
FYI 9 year olds are not old enough to be inside a dog pound to help with anything.
