Woman files civil suit over accident

WARREN

A woman injured during a traffic crash involving an off-duty Warren police officer has filed a civil suit over the accident.

Jessica Dilworth of Warren filed the suit in Trumbull County Common Pleas Court. She is seeking at least $25,000 in damages. The suit names as a defendant Benjamin Harrell of Warren.

Harrell, a Warren police traffic officer, was charged with DUI after the October 2010 five-vehicle accident on Youngstown Road.

Dilworth suffered injuries after Harrell’s vehicle hit the back of her vehicle, the suit said.

Prosecutors dropped the DUI charge against Harrell after determining that the blood-alcohol reading obtained from Harrell would not be admissible in court because Harrell calibrated the breath-test machine he was tested on.

Dilworth’s injuries resulted in $18,683 in medical expenses, the suit said.
