Maximum penalties sought for child porn

Ex-Valley Disc jockey to be sentenced today

Possessors of child pornography participate in the exploitation and victimization of children and should face substantial consequences, according to a prosecutor and a social worker who specialize in justice and emotional healing for victims.

They made their comments in advance of today’s 11:30 a.m. sentencing of William “Scott” Kennedy, former longtime Y-103 morning disc jockey, who pleaded guilty to possessing child pornography.

Kennedy, 55, of Hermitage, Pa., will be sentenced in Pittsburgh by Senior U.S. District Judge Alan N. Bloch.

“Crimes against children are the most serious offenses and should be punished accordingly,” said Natasha Frenchko, an assistant Mahoning County prosecutor, who advocates prison time for those who possess child porn.

“The children who are depicted in child pornography in these sexually explicit activities are continually victimized every time that they (the images) are downloaded, viewed or possessed,” said Frenchko, who is assigned to the violence against women and children unit.

Based on Judge Bloch’s comments in a $3,550 restitution order for one of Kennedy’s victims, which he issued Monday, a prison term seems almost certain for Kennedy.

“In the event that full payment of restitution has not been made at the time the defendant is released from the Bureau of Prisons, payment shall be required as a condition of the defendant’s supervised release,” the judge wrote.

“I believe a consequence is necessary. Whatever form that consequence takes I believe is probably a part of their treatment,” Sande Miller, social worker and clinical supervisor at the D&E Counseling Center, said of offenders.

Among those consequences could be requirements for treatment of the offender and for restitution, said Miller, who specializes in counseling young trauma victims, including those who’ve suffered physical and sexual abuse.

“The person (viewing the child porn) is witnessing the occurrence of a horrendous crime, and they’re most likely purchasing it,” Miller observed. “There’s always a child on the other side of that lens who’s being sexually abused and exploited.”

Lifelong emotional consequences tormenting those who were sexually abused as children may include depression, anxiety, post traumatic stress disorder, juvenile delinquency, substance abuse and relationship difficulties, Miller said.

Miller also spoke of the restitution recipient in the Kennedy case, now in her 20s, who continues to be a victim of the circulation of the Internet image of her being raped as a child.

“It’s something that she will relive the rest of her life, but, unfortunately, if it’s marketed onto the Internet, her private humiliation becomes even more public, and she’s revictimized again and again” by child pornography viewers, Miller said.

Frenchko said she isn’t surprised 21 people, including locally prominent people in the broadcasting and banking industries, wrote testimonial letters to the judge praising Kennedy’s character and charitable endeavors.

“Ordinarily, people that are possessing child pornography are doing it secretly and in private, so it’s not surprising that people are coming forward in his defense,” she said.

Kennedy, who has been jailed since his May 3 guilty plea, faces up to 10 years in prison and a fine up to $250,000, or both.

Federal investigators first became aware of Kennedy in an Internet chat room, then searched his home, seized his computer and discovered the illegal files in December 2009. The files included three videos and 238 images, including some of children under age 12.

Federal court documents say some of this material showed minors engaged in sex acts and that the FBI was able to identify 19 victims from Kennedy’s videos and images.

“He certainly had to have known what he was doing was wrong,” Frenchko said. “Was he deeply remorseful before or after he got caught?” she asked.


Here are some facts concerning child pornography from a national child welfare advocacy organization:

It is a federal crime to knowingly possess, manufacture, distribute or access with intent to view child pornography.

All 50 states and the District of Columbia have laws criminalizing the possession, manufacture and distribution of child pornography.

Child porn exists in multiple formats, including print media, film, videotape, CD-ROM and DVD.

Child porn is transmitted on various Internet platforms, including newsgroups, chat rooms, instant message, file transfer protocol, e-mail, websites and peer-to-peer technology.

In a one-year study of 1,713 people arrested for possessing child porn, the defendants ran the gamut of income, educational attainment, marital status and age. Almost all were men, 91 percent were white and most were single.

In the above study, 40 percent of arrestees were dual offenders, who sexually victimized children and possessed child porn, with both crimes discovered in the same investigation.

More than half of the victims shown in child porn were abused by someone who had legitimate access to them, such as parents, other relatives, neighbors, family friends, babysitters and coaches.

Of all child porn victims identified by law enforcement, 42 percent appear to be pubescent, 52 percent appear to be prepubescent and 6 percent appear to be infants or toddlers.

Child porn images are crime scene photos, which create a permanent, irretrievable Internet record of the abuse of a child, whose life is forever altered and who is re-victimized every time the images are viewed.

The reality of pedophiles in the world have created innocent victims in more than just harming the children physically and emotionally. They created mass hate and hysteria in society at large with their deviancy and made it easy for people like me to get falsely accused and convicted of sex crimes that never happened. I spent 12 yrs (TWELVE YEARS) in prison accused and convicted of raping a 4yr old child repeatedly for 9 mos. merely on the testimony of a child who was programmed behind closed doors over 14mos. by an overzealous investigator who hated me because I wouldn't admit to something I didn't do. No physical evidence when there should have been. The boy recanted not only before my original trial but went on the recant 3 (THREE) more times in open court over the next twelve years. I passed three polygraphs during the investigation. The boy was interviewed by the dean of forensics @Y.S.U.after he recanted the first time and showed NO emotional trauma whatsoever that he should have had he been brutally anally raped as was alleged I was robbed of my wife and the opportunity to raise my two daughters being removed from society. I've been out almost tens years now and thanks to the ingenious sex offender website I can't get as job to save my life and have been subjected to mob mentality vigilante neighbors wherever I've lived. People like YOU Mr. public figure radio DJ, I did all these wonderful things along the way and got caught and please slap me on the wrist now... THANKS FOR RUINING MY LIFE AND ALL THE THOUSANDS OF OTHER PEOPLE JUST LIKE ME WHO WERE COMPLETELY INNOCENT AND DIDN'T STAND A CHANCE IN FRONT OF A JURY WHO HATES SEX OFFENDERS AGAINST CHILDREN BECAUSE OF MEN LIKE YOU. The Innocence Project is doing a bang up job proving through D.N.A. just how many innocent people have been rotting away in prison for years at the hands of overzealous investigators and prosecutors who suppressed evidence to gain convictions for re-election time. Most cases I've seen like this, the perpetrator gets off easy when they admit to their crimes but if you plead not guilty and get convicted they throw the book at you. I WAS INNOCENT AND CAN STILL PROVE IT. The only problem is, it would take honesty and integrity and the ability to admit wrong doing by the investigator, the prosecutor and the trial judge. I don't know how long I can hold my breath waiting for that to happen.

I agree with you Stan ( for once ). Can't they do more to track them based on the servers? I'm not the most tech savvy, but would think with the right manpower they can catch the perps easier?

With the chat rooms available to them along with file swapping those who own the servers are facilitating the lifestyle of these perverts . SHUT THEM DOWN ! This is no different than allowing them to have a clubhouse in your town .

Real justice should also involve prosecuting the sources where William “Scott” Kennedy got the porn from . Not shutting them down allows this crap to spread .

Locking him away does, indeed, help as potential victims--from Scott Kennedy--are safer with him beind bars. He should begin his sentence by identifying all sources of origin of the pornography.
Jazzman-while I absolutley hate to see anyone persecuted that is innocent-I must say it is extremely rare in cases alleging sexual abuse of children. Usually the perpetrators go free since the children are re-victimizied by ruthless defense lawyers and made to look like liars, usually unable to go through with testimony due to damage already done. So your case, if it's true, is extremely rare.

Yes my case may seem rare at this time in history only because the reality of people like me who got systematically accused and convicted by overzealous children services investigators and run up the flag pole by a systematic judicial system (the good ole' boy network) and the, as I stated before, mass hysteria and hatred created in society by people like Mr. Kennedy. Again I refer the The Innocence Project and all the individuals who have been found to be completely innocent by way of D.N.A. and exonerated and released from prison is finally revealing how the wheels of justice in these cases sent INNOCENT people to prison because of the prejudice against being accused of sexually assaulting a child. The documentation in my case had more proof that I was innocent than the prosecution had to convict me, yet 12 people believed the horrendous accusations made against me and I got convicted. I wish I had 12 bridges for sale. So, because I got convicted that's supposed to carve it in stone that I actually did it. Since there was no D.N.A. in my case to undeniably prove my innocence (because no rape took place) the only way for me to be exonerated would be for Pharaoh, I mean the trial judge, to acknowledge the four (4) different times my alleged victim recanted the horrendous accusations made against me in the first place. I 've spoken to more than one attorney in the last ten years I've been out ( AND HAVEN'T "RE OFFENDED" ) and none of them will touch my case because of the obvious corruption involved in attaining my conviction in the first place. Don't want to ruffle any feathers on the climb to the top I suppose ? I guess I'll go to the grave knowing that three of us know the truth. God is always watching...
