Death row inmate has hearing for new trial

Published: Fri, January 15, 2010 @ 4:51 p.m.

YOUNGSTOWN — Mark Aaron Brown has been on Ohio’s death row for nearly 16 years, but new testimony from two old witnesses could land Brown a new trial.

Judge Maureen Sweeney of Mahoning County Common Pleas Court heard testimony today from two men who, as juveniles, testified against Brown during his trial. Both men had much different accounts of Brown’s crime than that told to the court 16 years ago, but prosecutors say the men are being less than truthful.

Brown is scheduled to die Feb. 4 for killing Isam Salman and Hayder Al-Turk in a North Side convenience store in January 1994. Brown, 21 at the time of the murders, was high on drugs when he entered the Midway Market and shot Salman, the store’s owner, and Al-Turk, a clerk working in the store.

Myzelle Arrington, a then 15-year-old juvenile in trouble with the law, testified against Brown during the 1994 trial. Arrington, now 31, says he lied on the stand in 1994 primarily to gain favor with prosecutors in regard to his own legal troubles.

The subculture rises to defend after sixteen years . After memories dim it suddenly doesn't seem like a crime . Will they be able to spring Mark Aaron Brown ?

Stan lets just make sure he should have the death penalty. I dont trust Philomena as he was corrupt so lets just let this Prosecution team and Judge make sure he had a fair trial.

wow, what an abundance of ignorance, but, then again, can't expect too much given the commenters.

"Brown, 21 at the time of the murders, was high on drugs when he entered the Midway Market and shot Salman, the store’s owner"

He killed a human being. Put him down. No excuse to kill a innocent person. As far as the other two witnesses, who cares. They lied once and I'm sure there capable of lying again.

The subculture has decided that if they don't hang together then they will hang separately . Will their new reinvented testimony be enough to spring Mark Aaron Brown and save him from the executioner ?

What I still dont understand how some people can murder someone get time and get eventually get out and be back on the street, someone else either get life or sentenced to die. I think we need to do what some other countries do the eye for an eye law or just something different.

If I was investigating this case I would see if there was any contact between these two witnesses and Mark Aaron Brown's family . With the execution date fast approaching along with reinvented testimony being presented I suspect contact and a plan being formed .

I think the people that who had to listen to these witnesses would understand while a lot of us are upset we (the victims) are upset. Both witnesses were a joke and just making the families wait longer and have to relive everything again.
