Campbell lawmaker says gun prohibition takes away rights

Published: Thu, January 7, 2010 @ 12:06 a.m.

STAFF REPORT

CAMPBELL — City council passed legislation that will stop gun stores from locating within the city limits.

The emergency legislation, passed at council’s regular Wednesday meeting, prohibits the sale or manufacture of deadly weapons in the city.

It comes two months after a Hubbard man tried to get a zone change for property he owns on Robinson Road so he could open a gun-repair shop there. Police opposed the zone change, and council denied the request in December.

The wording of the legislation, which generally prohibits gun sales and doesn’t specify gun stores, prompted council member Juanita Rich to vote against it.

“As a card-carrying member of the NRA, does that take away my rights?” she asked city law director Mark Kolmacic.

“It does,” he replied.

Patrol Officer John Gulu, who is secretary-treasurer of the Fraternal Order of Police Lodge 42, told council the union thanks it for passing the legislation.

He said that as a gun owner, he would not mind leaving the city limits to sell one.

Rich said after the meeting she does not want a gun store to locate in the city.

She said that as a private citizen, however, she should be allowed to sell her gun in her home.

“If it were worded differently, I would have supported it,” she said.

What rights Councilwoman? The 2nd Amendment had never been incorporated via the 14th Amendment by the Supreme Court to be applied to any state/local action. Therefore it cannot be interpreted to extend any protection against what a city council may do regarding guns/firemarm regulation.

So what rights?

Campbell has a ghetto portion to it that does not need a gun store which repairs or sells firearms. Good job Council and Mayor for sticking together on a such an important issue.

Good job Councilwoman for taking an issue, which has almost 100% concensus among residents that a gun store would be bad for the City, and turning it into a political issue to merely oppose any move made by Mayor George.

Amen Bman. Thats all that councilWOMAN does is oppose whatever the mayor puts on the table. As well as the other council members but at least they SOMETIMES have a brief moment of inteligence where they agree!

The right she is talking about is if she owns a firearm and wants to sell it she can't sell it inside of the CIty limits because of this legislation, it states that no one can sell firearms inside of the city limits.

The legislation should have read no firearm dealers can sell firearms inside of the city limits.

so she is not way off base on this one.

Bman,

I think there are a couple of Supreme Court Cases that are going to incorporate that right. They follow the Heller decision last year that stopped DC from barring handguns inside the Districts limits.

She is one example of why the city of Campbell is going from bad to worse. Give the Mayor and the rest of council credit on this one.

Support the subculture of Campbell Ohio ! Ban the posession of firearms ! Stopping sales isn't good enough . What about the guns the homeowners already have ? The next home invasion could result in the bandits being shot .

The thugs steal their guns and don't abide by the law . They have a dangerous profession when their victims are armed . The issue of their safety should be given top priority !

Simple Common Sense (In English):

In a foolish attempt to think we can stop criminal Hoods and Thugs from using dangerous weapons, our leaders decide to outlaw certain weapons thru legislation which restricts law-abiding citizens the right to protect themselves against those Hoods and Thugs who disregard those laws.

This type of legislation simple clears the way for the Hoods and Thugs to be safe while they commit their crimes with illegal weapons, because they know the law-abiding citizen cannot have a legal weapon to protect him or herself.

What part of these two sentences do they not understand?

Perhaps Bman may want to endeavor to read the US Constitution again or perhaps Art I, Sec. 4 of the Ohio Constitution. There is nothing unlawful about commerce or the commerce of arms. This action is certainly a step towards the destruction of legitimate commerce and a degradation of rights. Perhaps you would be wise to read the full opinion in the Heller case.

That's the way! You surely don't need any MORE businesses to open up in Campbell! The traffic from all the commerce in town is just crazy! besides, they have more than enough tax revenue as it is!

the ordinance was taken from another city in ohio who has already passed and acts on this legislation so it will hold up in a court of law 100%.

Campbell is 2miles by 2miles, is it so difficult for a person to walk across the street like to coitsville, struthers, or even youngstown. 422 and struthers liberty road have parts that half the street is Campbell and the other have is Youngstown. Just go stand across the street.

This is to protect our citizens from a gun shop that wants to open across the street from the projects and they specialize in selling semi auto machine guns. Get a grip and just think of this logically.

The problem is the city has an understaffed police department that is so over worked the officers are barely able to have any time for themselves. I as a citizen feel that business in the city is great but a gun store, come on really. You also have negative things to say about Mayor Krinos. How would you feel if the store is broken into and the semi auto machine guns are on the street and used to rob your house. This has nothing to do with owning a gun. We have the right to bare arms, but a gun store by the projects. Any one who thinks this is a good idea is really just being a plan old fool.
FYI, I WOULD REACH FOR MY PHONE CALL THE POLICE AND THEN MY GUN.

It's called "common sense" and that is so hard to explain nowadays. Losing cause.
And btw, I to, would call the police first and then get my rifle.

"There is nothing unlawful about commerce or the commerce of arms..."

Absolutely correct.

There is also nothing unlawful about regulating the commerce of arms. ;)

You limp-wristed pansies are the reason we have high crime. At the sign of danger, you hide under the bed and wimper. How pathetic are you? You turn your streets and neighborhoods over to thugs because you are afraid to stand up. You are a disgrace to your citizenship.
In EVERY city/state with strict gun legislation, you have higher crime rates than in those which do not.

Can you add 1 and 1?? I didn't think so. Or do you believe thugs will honor your begging and leave you in peace?

Why are you against private gun ownership? You think only the government should have guns?? Which fantasy world are you in? In this world, criminals TAKE ADVANTAGE of unarmed victims.

If you don't care to own a firearm for defense purposes yourself, that is YOUR RIGHT, and your CHOICE. But don't impose YOUR choice onto others and DENY them their RIGHTS. We are the ones who help keep crime down by making the thugs think twice.

The women in Florida have long proven what makes criminals think twice. After Florida's concealed carry law was passed, many took training and got permits, and crimes like rape and assault decreased.

Remember, NOBODY ever raped a .38. If you don't want to defend yourself, fine. But keep your cowardly mitts off our rights.

Cowardice has a heavy price.

Arguably the greatest Statesman and Philosopher ever born on American soil had this to say to the likes of you:

"Those who would give up essential Liberty to purchase a little temporary Safety, deserve neither Liberty nor Safety."
BENJAMIN FRANKLIN

Never said about having a gun in the house, talking about operating a gun shop in Campbell, someone breaks in my home, they meet there maker.
Criminals are going to get guns anyway, so might as well have them travel somewhere else to get them. Not a good idea in Campbell to have a gun shop. Your just asking for trouble (breaking in the store, robbing the store, etc).
