Owner of Fat Man’s Auto Sales faces corrupt activity charge

YOUNGSTOWN — The owner of a Canfield Road auto dealership will be in court Oct. 15 facing an engaging in a pattern of corrupt activity charge.

Jonathan Smail, 24, Jackson Street, Campbell, turned himself in to authorities this morning. He is the owner of Fat Man’s Auto Sales that was searched Monday by Boardman police and other law enforcement officers.

Smail was the third person from the business who was charged.

Michael Mrosko, 32, and Jason Coughlin, 34, were arrested Monday.

Mrosko is charged with engaging in a pattern of corrupt activity. He worked in sales at the business.

Coughlin faces misdemeanor counts of marijuana possession and possession of drug paraphernalia. He worked as a mechanic at the business.

The investigation started in 2008 and Mrosko is accused of withholding titles from people who bought vehicles at the business until the vehicles were paid off.

A dealership is supposed to place a lien on a title until it’s paid off.

maybe some one should look into there buddies lot in campbell francos auto sales tthey use to trade cars back and forth and i heard they use to roll speed gages and use stolen parts but she us to be a cop and thats probley ok i guss .ill be real supprised if anyone even gets to read this we just have to wait and see

You would think that Boardman police department and the other agencies would have other worries trying to keep the streets safer for the taxpayers than going after a business owner who kept titles to cars that the buyer could not pay in full. I sure hope that a killer, rapist or bank robber did not get away because these agencies had light workloads. As a taxpayer, this story makes me sick! I am not quite sure why this is a "scam" that Mr. Mrosko kept the title. The fact the buyer used fictitious or fraudulent plates should not be his responsibility. If a buyer defaults, is the seller not entitled to be able to reposses the property and resell it? The buyer was not forced to buy under those conditions.

Using words like “engaging in a pattern of corrupt activity and racketeering” appears to be the enforcement agencies way of trying to make a case which would compare to a New York or Chicago case from the 70s. I hope that Mr. Mrosko has the funds to hire competent legal counsel and not only beats these absurd charges but then goes after the city of Boardman and their fine police department.
