CANTON, Ohio (AP) — An arbitrator has directed the state Highway Patrol to reinstate a sergeant who was fired after authorities said he didn’t stop some troopers from cheating on a test.
Sgt. Mark McDonald was fired in September.
He was among 11 patrol staff disciplined amid allegations of cheating on the April 2008 certification test for a device used to gather evidence against suspected drunken drivers.
McDonald told the arbitrator he had thought a trooper who mentioned a cheat sheet was only joking.
Ohio State Troopers Association lawyer Herschel Sigall says McDonald will return to the Canton post with full back benefits. He says the discipline will be erased from his personnel file.
The patrol today said it is processing paperwork for McDonald’s return.

We are now condoning cheating (i.e. breaking the law) to the same people who are to ticket us for cheating on the speed limits, seatbelts etc?
If cheating was going on who was the test monitor? Why was this guy fired. Sounds tome like lax policies in place.
Nobody is condoning cheating, the guys that cheated were promptly fired. The sergeant was accused of not stopping them just because a guy made a joke about a cheat sheet. Thing is, it's not a test people would usually need to cheat on so he brushed it off as a joke.
Who hasn't cheated on a test? Can you honestly say you've never cheated on a test? I've cheated on countless tests. I'm not going to judge this guy based on cheat sheet allegations regarding a test about a stupid piece of gear. I love cheat sheets! Grow up.

Those who cheated should have been sentenced to thirty days of washing OHP Cruisers . :) This would really clean up their act.
What would the consequence be if a civilian would try and cheat on a sobriety test? I bet we would be cuffed and hauled off to jail. They should be held at the same standards they require us to be.
