WARREN — Dr. Mark E. Davis, a 47-year-old Howland osteopathic doctor with an office on state Route 193 in Vienna, has pleaded guilty to two counts of drug trafficking.
Gina Arnaut, an assistant Trumbull County prosecutor, said the two charges stem from two videotaped incidents in Dr. Davis’ office — one in August 2006 and one in January 2007 — in which Dr. Davis wrote a prescription for Schedule 3 drugs to a confidential informant in exchange for sexual favors.
The incidents with the confidential informant occurred after complaints were received by the Ohio Board of Pharmacy, which conducted an investigation, Arnaut said.
Dr. Davis, of Brittany Oaks Trail, appeared in Trumbull County Common Pleas Court Tuesday and pleaded guilty to a bill of information, meaning he waived his right to have a grand jury decide whether he should face criminal charges.
Dr. Davis was handcuffed at the end of the hearing and taken to the Trumbull County Jail, where he was photographed and fingerprinted before being released on $2,500 bond.
Judge Andrew Logan will sentence Dr. Davis in four to six weeks, after the Trumbull County Adult Probation Department conducts a presentence investigation.

Anyone know what the penalty (Federal?, State?) guideline are for this offense?
I would say that pleading guilty to two counts of drug trafficking (felony) would be a permanent suspension of his license to practice. The State Medical Board would make that determination. But, that is just the tip of the iceberg with this office. HIPPA violations, dispensing samples of medication without logging who,what, where and when it was given to. This Doctor settled out of court on two previous sexual improprieties in his office. Too much more to go with here.
i cant believe that. he's my doctor too and he did not seem like the person who would do something like that. its ashame that people have to do stuff like that and for those incidents, their whole career is over with.
Dr.Mark Davis has been my Dr.for a handful of years.I am only 45 years old,and in chronic pain from a truck accident in 1978.Dr.Mark helped me turough one and a half years of serious pain where I could not even take care of myself daily,hardly at all. Lots of bedtime.Could do nothing but lay in bed or cry.No one cared but Dr.Mark.He is why I did not give up.Finally Ohio re-upped a program for those with a pending S.S.I.case and I received a medical card.Dr.Mark immediately sent me to a pain mgt. clinic where I now have Hope.I will always be grateful for his care.And He was always a gentleman,and Proper.And He cared.
what gets me is that his staff new what was going on , yet nothing is going to be done about them. then learning that after he pleaded guilty he is allowed to practice untill his sentencing . come on now . who knows what he was doing before he came into the room to look at you . disgusting .he should be put in prison and patients of his should get together and file a lawsuit against him

Who told you that his staff "knew what was going on"? The last time I talked to them (very recently), they continue to support Dr. Davis and the fact that this situation is sad and unfair, especially to his patients who continue to come to him for the great care he has given them for years. You have no idea what the "guilty" plea means, so you need to re-read the article above. He did NOT admit to anything, so please do not read into it. You have no right to judge when you do not know the facts.
ReserveJudgement: Yes, he did a lot of good things for his patients. But his boys, hopefully will not pay the price for his stupidty. His wife has known all these years what he has been doing.
The FACTS are, he plead guilty in a plea bargain to avoid a trial. After a plea of guilty, he can be sentenced immediately. I'm sure that he would not have wanted to go through a trial and have the tapes played in court for everyone to hear.
YES, the staff knew a great deal of what was going on. But, who would bite the hand that feeds you? DUH If you would like, I could write a long, factual history on his sexcapades. I KNOW the facts! You would like to hear more?

I am not God, nor are you. He is the only one who will judge all of us. That is all that I am saying. I am not telling you what you can or can not say. You have made your opinions known REPEATEDLY. If marriages were ruined and children were hurt, that is a terrible thing, but there is another party involved there who needs to share the blame. This needs to end. So you say! My accusations are not unfounded! He ruined my marriage and the lives of my three children. He lured my wife into an affair with lies and promises! She moved out, only to be dumped by this creep and pervert, six months later. Do I have anger? Yes I do. Inflicting pain? You must be a total moron on drugs. This bantering back and forth regarding Dr. Davis between Micky and ReserveJudgement could actually be considered rather entertaining if it wasn't for the fact that I am PERSONALLY aware of the damage that he has caused. I was one of his "victims" and his behavior toward me was at best unprofessional and at worst abhorrent. I'm sure I am one of many that fell prey to this man in one way or another and I agree with Micky that his punishment should be severe. Let's see who's side the real judge will take. (By the way, I am not the confidential informant - just one of many patients who was taken advantage of.)
