No free attorney for man accused of hurting son

Published: Wed, December 23, 2009 @ 3:00 p.m.

STRUTHERS — A New Springfield man accused of injuring his infant son is to return to court for a preliminary hearing Dec. 30.

David Bowdish, 26, of Struthers Road, appeared today before Judge James Lanzo on a child endangering charge filed by Springfield Township police.

The judge set Bowdish’s bond at $50,000, allowing him to post 10 percent, or $5,000.

Bowdish, dressed in a Mahoning County Jail jumpsuit, said that he works at KFC, earning $9 per hour. Judge Lanzo told him he would need to hire an attorney.

Police were called after Bowdish’s nine-week-old son, Kaleb, was transported to the hospital because he was having difficulty breathing. The baby was flown from Akron Children’s Hospital in Boardman to the Akron facility.

Doctors told police that the infant’s injuries weren’t consistent with Bowdish’s explanation that he had been bouncing the child on his knee. The doctors believe the baby was shaken.

Bowdish remains in jail and the baby is in fair condition.

Finally, A judge rules that an accused must hire an attorney. More judges should follow the lead!

In order to be provided an attorney free of charge, you must show that you can't afford one. The judge in this case ruled that since the accused had a full time job, he had the funds to hire an attorney. There are attorneys available who will work for a very low cost.

While this matter is suspect and of nature that we don't look upon favorably (child abuse or endangerment) - someone making $9 an hour can't afford a lawyer. Based on the nature of charge, expert witnesses will need to testify on behalf of defendant. This alone could cost most of what this guy makes a year. Combined with a competent lawyer's fee of $150-400 per hour, his entire income is not enough to cover the case cost.

No saddad it isn't retarded, whats retarded is shaking your 9 week old son,and having the baby flown to Akron Childrens Hospital in Akron.WHO IS THE VICTIM HERE and don't give me some garbage that ,he is innocent until proved guilty.Hurting a child is unspeakable, and he should and will pay,for his crime.

To many fathers and boyfriends abuse, children because they don't know how to cope with crying, and a baby being fusy.I'm glad the judge had the guts to issue that ruling, howver I'm sure it will not stick.

Respect human life, don't abuse an infant child, and there is no need for an attorney.
