YOUNGSTOWN — David P. Aey, disqualified by the Ohio Supreme Court as a Mahoning County sheriff candidate, is looking to seek the seat as a write-in candidate.
Ohio Secretary of State’s spokesman said today that an October 2007 Supreme Court decision says such an action can now be done.
That means Aey of Boardman, a former deputy sheriff, can file as a write-in candidate. The deadline for write-ins to file is Wednesday.
However, his eligibility is another story.
Aey was removed from the Democratic primary ballot by the Ohio Supreme Court in February.
The court rules Feb. 14 that Aey wasn’t eligible because he lacks two years of supervisory peace officer experience at the rank of corporal or above, which state law requires of candidates for sheriff.
A federal judge upheld that court’s decision on Feb. 26.
Aey hasn’t done anything since that decision to obtain those two years of supervisory experience.
Aey couldn’t be reached today to comment. But he obtained a write-in declaration form Tuesday from the county board of elections and there are signs urging voters to write-in Aey’s name on the November ballot.
Sheriff Randall Wellington says he would consider taking legal action against Aey should he be certified as a write-in candidate.
For the complete story, read Friday’s Vindicator or vindy.com
I have never seen a man so afraid of losing his job to someone he and the state have deemed "unqualified". Wellington will do anything to keep Aey off the ballot because he knows Aey will win if voters are allowed to vote for him. What a scared incompetent man.
Aey needs to go back to 1st grade and learn the meaning of the word "NO". if he had put this much effort into his education he would have had the degree needed to qualify for the position he seeks.
guess again Woodrow. Mr. Aey IS qualified under ORC 311. More to come....
This article is another bad case of journalism. It's either/or. Either supervisory experience or a two year degree or its equivalent in semester/quarter hours. America holds itself out as a model for free elections...except in Mahoning County, Ohio.
Furthermore, under the guise of operating in a democratic environment, all Americans are created equal but the plain truth is some are apparently more equal than others. Remember, the rules governing running for 'shire-reeve' are much more restrictive than running for President of the United States.
It's is al lbecuase of someone named wellington. He tried to prevent him form running but he couldn't so he wil lactualy ahve to run agaisnt somebody.
Tugboat is exactly right. Irresponsible "journalism" by the vindy (biased spin is more like it). Did they bother to check if Mr. Aey filled either of the requirements? As a very active member of his campaign, I can assure you Mr. Aey is has more than fulfilled the necessary requirements under 311. It does seem typical that Wellingtons only platform isn't issues but rather clearing the ballot for him to run unopposed.
Which is just plain wrong. Talk abut stealing a election.
Obama when he first ran for the State Senate, he got all of his opponents thrown off the ballot. Best to run scared or unopposed.
Still yo might as wel lsjut give hi mthe job as sherriff if thats' the case.
I hope he(Aey) is successful.... You just have to wonder why Wellington is so afraid to go up against him. If I was so confident in my leadership, qualifications and education I sure wouldn't waste my time fighting to have competition eliminated. Good luck, Aey!
All i know is Mahoning county needs a change in that office. I will be putting Mr.Aey as a write in. As for Woody being up Obama, get a life! We are talk about the Mahoning County sheriff.
Wellington just does NOT want a OPPONENT "cause he KNOWS what the outcome would be!! ~~ there were others that were dis-qualified in running against Wellington. God Bless Aey if "THEY" allow him to be a write-in ~~ you all pretty much KNOW the up coming ANSWER to that. Its called POLITICS in Y-TOWN!!
ANd it is nothing but corrupt.
Before everyone who supports Mr. Aey gets angry, Welington WILL file legal action against his running as a write-in. Just know this. Mr. Aey, through a lot of hard work, not only meets the qualifications needed to be on the ballot, he exceeds them. Any attempt by Wellington to discredit Mr. Aey at this point will be sheer desperation by him to run unopposed. I was taught in grade-school that this country was established on a democracy, letting the people decide, abolishing tyrannical dictatorships. Truth be told, Wellington DID NOT meet the requirements when he was appointed in 1999. Fact: He {Wellington] did not have the required OPOTA certification (police academy training) needed under ORC 311.01 (8)(a)to be sheriff. Fact: He claims he was "grandfathered" on the OPOTA certification. Fact: No addendum to this law (not even case law) exists that a "grandfather" clause exists.
Regardless, Mr. Aey welcomes the challenge of running against him and any other opponents. Then again, Mr. Aey runs his campaign on the foundation of "Government of the people, by the people, for the people..."
Indisputable fact: Wellington, who claims he "ran the mob out of town" has his own unique relationship with organized crime members. Fact: the following is quoted from the 2002 Congressional Record.
"Lenny Strollo told him about Biondillo running stags in the City of Youngstown and they wondered how he was able to do it. Lenny Strollo told him he heard that money went from Biondillo through Vic Calautti to the Randall Wellington campaign and that Biondillo had to have the okay from Wellington to be able to hold stags inside the city of Youngstown.
(Page 45). He said that he heard that Biondillo paid $25,000 to Vic Calautti to donate to Wellington’s campaign."
Fact: After several attempts, Wellington has unsuccessfully tried to have this removed from the Congressional Record.
Speaking for myself, it is becoming quite clear just what it is he is trying to hide. I wonder if anyone else on his staff has anything to hide. {hmmmmm....}

Above you will see the link to public record which links Wellington to organized crime figures in the Mahoning Valley. Enjoy. And to the second poster, woody, learning the word "no" doesnt mean giving up and throwing in the towel. I sure am glad that early settlers in north america didnt take no for an answer. You are an imbecile.
As for 'Aey4sheriff', it's obvious your most likely a family member, making your opinion not wanted in this forum!
Please do all of us a favor, do not waste a write-in vote on Aey. He does not have the two years of supervisory experience, which will again disqualify him. Wellington will win his legal action again. Why throw away a vote. Such a waste of time and tax payer dollars.
If anything, I wish a reputable third candidate would try to run for this office...we do need new blood...but not another member of the extended Aey family!
I am voting for Aye. It is not a waste of a vote. It's the right vote for a change in the Mahoning County! If you read the laws right it is two years of supervisory experience or two years of college. I would rather someone new like him then and old man who needs to retire! Please "Aye4sheriff"'s opinion is very much welcome in this forum. Didn't you ever learn you should never assume anything? Maybe this person is a strong supporter of Mr. Aye and a change for our valley!
If that's true, they are more than welcome to prove me wrong! I think their username shows they are either a family member or active campaign worker. I'd prefer to hear from those not connected with the family...as their opinions are not biased.
