Mother files lawsuit against grocery store

RAVENNA, Ohio (AP) -- The mother of an Akron man who died after employees and customers at a Giant Eagle supermarket restrained him has filed a wrongful death lawsuit against the store. Mary Niskanen of Akron filed the suit Wednesday in Summit County Common Pleas Court.
Her son, Paul Niskanen, 31, of Akron had left a Giant Eagle supermarket in Rootstown, Ohio on Jan. 22 when he was confronted in the parking lot by two store employees who suspected him of shoplifting $261 in groceries. A struggle ensued, and several customers joined in restraining Niskanen.
When Portage County deputies arrived, Niskanen was face down in the parking lot, and two people were sitting on him.
Niskanen was limp and had no pulse. He was pronounced dead at Robinson Memorial Hospital.
The Summit County medical examiner ruled Niskanen died of inability to breathe.
A grand jury declined to indict anyone in the case in June.
