YOUNGSTOWN Man drops lawsuit against 2 officers

YOUNGSTOWN -- A lawsuit filed last week against two city police officers was dropped Tuesday and won't be refiled.
"He didn't want to go through another trial," said Atty. James R. Lanzo, who filed the suit for Thomas R. Cole Jr. of Struthers.
The suit, filed in Mahoning County Common Pleas Court against officers Christopher Lombard and Mark Rakocy and the Youngstown Police Department, sought at least $125,000 in damages.
Lombard and Rakocy were accused of assaulting and robbing Cole in the restroom of the Pulse bar on Market Street, Youngstown, while they were off duty in March 2001. A common pleas court jury found them innocent in January.
Lanzo said Cole had contacted him about the civil suit before the criminal trial began. Lanzo was unable to locate Cole to find out whether he wanted to go ahead with the suit after the acquittal.
Because the statute of limitations was about to expire, Lanzo opted to file the suit with the option of dismissing it if that's what Cole decided to do.
Lanzo said Cole contacted him this week, after the suit had already been filed, and asked that it be dismissed.
The suit was filed without prejudice, which means it can be refiled within a year, but Lanzo said that won't happen.
