The Mitchell trustees have asked for another hearing before the full appellate court; meanwhile, publication of the book was allowed. The publisher rushed to get the book into stores in June, and the controversy seems to have sparked healthy sales -- the novel has already sold well beyond the publisher's originally planned 25,000 copies.
