Pavlik files suit to settle dispute



The suit is against co-manager Anthony Scandy, whose contract expired May 12, 2007.

YOUNGSTOWN — Boxer Kelly "The Ghost" Pavlik of Youngstown, a world championship contender, has filed a lawsuit in the Mahoning County Court of Common Pleas against co-manager Anthony Scandy of Youngstown to settle a dispute that has arisen between both parties.

Pavlik's complaint for declaratory judgment against Scandy has been assigned to Judge John M. Durkin. The case was filed last Friday.

Pavlik, who is scheduled to fight for the WBC middleweight championship Sept. 29 against champion Jermain Taylor in Atlantic City, N.J., is asking the court to uphold the three-year contract between him and managers Scandy and Jody Riley that expired May 12, 2007, and prevent Scandy "from bringing any action against Pavlik for any claimed obligations beyond May 12, 2007."

Scandy and Riley, the latter's name not listed in the lawsuit, had a management agreement between Pavlik and his father, Mike, who also serves as his son's manager, from May 12, 2004, to May 12, 2007, during which time Scandy and Riley, referred to as "Managers" in the agreement, provided financial support for the aspiring boxer.

Pavlik is trained by Jack Loew at Southside Boxing Club.

Highlights of agreement

According to the agreement, one of the highlights of this financial support included that Scandy and Riley were to provide Pavlik "with a lump sum payment of $12,200 within seven days after the execution of this agreement."

Two other highlights of the pact were that the two managers agreed "to pay [Pavlik] $650 per month during the first year of the agreement; and "to provide Pavlik with a cellular telephone during the first year of this agreement."

In addition, the two managers agreed "to provide [Pavlik] with a 1993 Cadillac Eldorado," and "pay for all training expenses incurred by [Pavlik]."

In return, according to a highlight in the agreement, Pavlik agreed "to pay [Scandy and Riley] 13 percent of his purse" for each of the three years of the agreement, in addition to providing other amenities listed in the accord.

In Pavlik's other requests to the court, he is asking "for relief declaring that the 'Management Agreement' expired on May 12, 2007; and "for relief declaring that the Plaintiff has no further obligations to Defendant under the 'Management Agreement.' "

Also, Pavlik is asking the court "for relief declaring that the Plaintiff has no obligation(s) to the Defendant relative to any managerial (or other) services relative to any bouts, fights, athletic contests and/or other events occurring after May 12, 2007."

Also, Pavlik is asking the court "for relief declaring that Plaintiff's bout scheduled Sept. 29, 2007, is not subject to the 'Management Agreement' and that the Defendant does not have a claim to, or interest in, monies earned and/or received by Plaintiff relative to said bout."

Asks court for clarification

And in conclusion, Pavlik requests the court to "issue a determination of the rights, liabilities, and obligations (if any) of the parties under the 'Management Agreement'; and "that the court award all such other and further relief, including costs, interest, and attorney's fees and costs as may be necessary to further the interest of justice."

Pavlik's attorneys in the case are Mathew D. Gurbach and Carmen V. Codjoe of Youngstown.

Attempts were made to contact both attorneys and Scandy Monday for their comments on the case, but they were not available. A message was left on the attorneys' voice mail, while Scandy's telephone number was not provided by the court document and is unlisted in the telephone directory.
